TERMS AND CONDITIONS OF ATTENDANCE

The terms and conditions as set out herein (“Additional Terms”) govern your attendance at and/or participation in the India Today Group’s event called 'Sahitya Aaj Tak 2024' (“Event”) scheduled to be held at Major Dhyan Chand National Stadium, New Delhi (“Venue”) between 22nd- 24th November, 2024 and also govern your usage of the Platform (defined herein below). These Additional Terms constitute a legally binding agreement between T.V. Today Network Limited (a part of India Today Group) (“TVTN”, “we”, “us” or “our”) and the attendee of the Event (“you” or “your” or “user” as the context may permit).

It is hereby clarified that your use and access to the Platform continue to be governed by the terms and conditions of the India Today Group (“Original Terms”), as applicable and in force prior to these Additional Terms as set out herein are in addition to the Original Terms. The Original Terms and the Additional Terms together shall collectively be referred to as the “Terms”. Any accessing, browsing, or otherwise using of the Platform indicates your agreement to the Terms, our privacy policy and any other policies or guidelines as may be applicable (collectively, the “Agreement”).

For the purposes of these Additional Terms: (a) “Platform” means www.aajtak.in/sahitya which includes its corresponding mobile application and any other means to access it as notified by TVTN from time to time; and (b) TVTN and you are hereinafter individually referred to as “Party” and collectively as “Parties”.

EVENT ADMISSION
1. Entry Pass. You are required to buy an entry pass to obtain entry to the Event priced at INR 499/- (Rupees Four Hundred and Ninety Nine only). The entry pass will allow you entry for all three days of the Event. Please note that buying an entry pass does not guarantee a seat. Seats will be allotted on a first come first serve basis. Further, the amount paid for the entry pass is non-refundable under all circumstances.
2. Admittance. Your registration entitles you to admittance to the Event. You must carry a valid ID card and an entry pass for admittance to the Event. Any and all other costs associated with your attendance (including without limitation any travel and/or accommodation expenses) shall be borne solely by you and TVTN shall have no liability for such costs. If you are registering on behalf of another it is your responsibility to ensure that the person attending is aware of these terms and accepts them, and by completing the registration you are warranting that you have made the attendee aware of these terms and that they have accepted these terms.
3. Attendance. During the Event, you shall conduct yourself in an orderly manner and shall not act in a manner which causes offence, annoyance or inconvenience to other attendees or speakers. You shall not canvass, promote, advertise or solicit for business in a manner which, in our sole discretion, is deemed unacceptable. We, in our sole discretion and without any liability or obligation, reserve the right to request your removal from the Event if we consider your presence and/or behavior to create a disruption, nuisance or hinder the Event and/or the enjoyment of the Event by other attendees or speakers; represent a security or health & safety risk to the Event and/or any other attendees or speakers; and/or fail to comply with, or are likely to fail to comply with this Agreement.
4. Media. By attending the Event you acknowledge and agree to grant TVTN the right at the Event to record, film, photograph or capture your likeness in any media now available and hereafter developed and to distribute, broadcast, use or otherwise globally to disseminate, in perpetuity, such media without any further approval from you or any payment to you. This grant to TVTN includes, but is not limited to, the right to edit such media, the right to use the media alone or together with other information, and the right to allow others to use and/or disseminate the media.
5. Eligibility: The Event is only open to users who are citizens of India and are aged 13 years or above and who are physically located and residing in India. Users below 18 years of age may attend the Event through their parents or guardian(s).
EVENT RULES AND REGULATIONS
1. Each attendee shall:
  a) observe the rules, policies and procedures of the Event Venue including in relation to health and safety and any reasonable instructions issued by TVTN and/or the management of the Event Venue and/or the online Event platform;
  b) behave in a respectful, professional and appropriate way that does not breach the laws or regulations of their home country or of the host country or that risks bringing the Event or the TVTN into disrepute;
  c) ensure you have adequate insurance for their own requirements, including personal accident and travel insurance, prior to attending the Event; and
  d) ensure you have all necessary travel documentation, including but not limited to visas and other entry permits into the country where the Event is held, and that you comply with all health formalities and any applicable laws.
2. You agree that your travel to and attendance at an Event is at your own risk and not the responsibility of the TVTN.
3. You must comply with the rules and regulations governing the Venue. If you bring any property to the Venue, you do so at your own risk. We are not responsible for any loss and/or damage to such property. If you are using car parking facilities at the Venue, you do so entirely at your own risk. We do not accept any responsibility for any loss and/or damage resulting from your use of such car parking facilities.
4. You shall not be allowed to use, consume and carry alcohol, tobacco products, or narcotic substances on the Venue.
5. You are not allowed to carry weapons, arms, hazardous substances or any such substances which are prohibited on the Venue.
PRIVACY
1. By making entries/transactions for the purpose of the Event, attendee(s) consents to and permits TVTN to send SMSs, e-mail or call him/ her, whether or not such sender is registered on the National Do Not Call registry. By registering for the Event, attendee(s) consents to being placed on a mailing/SMS list for promotional and other materials for TVTN.
2. Please note that providing any information to TVTN is by your choice. By registering for the Event, a attendee(s) agrees to allow TVTN to use the information provided by you.
INTELLECTUAL PROPERTY
1. All intellectual property rights in and to the Event, the Event content and all materials distributed at or in connection with the Event are owned by TVTN, and/or the Event sponsors or speakers presenting at the Event. You may not use or reproduce or allow anyone to use or reproduce any trademarks or other trade names appearing at the Event, in any Event content and/or in any materials distributed at or in connection with the Event for any reason without the prior written permission of TVTN.
LIABILITY/RESPONSIBILITY
1. You shall be responsible and liable for any loss, destruction or damage caused to the property at the Event Venue due to your act or omission.
2. TVTN shall not be responsible for any errors or omissions in the Terms & Conditions contained herein. All information provided in the Event is provided “As is” without warranty of any kind. TVTN makes no representations and disclaims all express, implied, and statutory warranties of any kind to the attendee(s) and/or any third party including, without limitation, warranties as to accuracy, timelines, completeness, merchantability, or fitness for any particular purpose.
3. Under no circumstance, TVTN or its affiliates and subsidiaries and/or their respective agents, representatives, owner’s directors, employees, officers, distributors, retailers, and advertising/promotion agencies shall be liable to the attendee(s)/user and/or any third party for any lost profits or lost opportunity, indirect, special, consequential, incidental, or punitive damages whatsoever, even if TVTN has been advised of the possibility of such damages.
4. TVTN or any of its affiliates will not be liable for any loss of earnings, or otherwise caused to the attendee(s) and arising as a result of his/her participation in the Event.
5. By attending the Event, attendee(s) will be legally bound hereby, to release from liability, and hold harmless TVTN, and any of its affiliates, employees or agents representing or related to TVTN and its services/products. This release is for any and all liability for personal injuries (including death), property loss or damage, in connection with any activity or directly or indirectly, by reason of the acceptance, possession, or participation in the Event, even if caused or contributed to by our negligence.
6. You shall indemnify and keep TVTN indemnified against all costs, charges, expenses, losses, claims etc. that may have to be incurred and/or suffered arising on account of any representations and/or declaration proven false or incorrect or breaches committed of the terms hereof.
OTHER TERMS & CONDITIONS
1. Any failure by TVTN to perform its obligations will be excused to the extent such performance is prevented due to reason of force majeure such as acts of God, explosion, labour dispute, failure of utilities, governmental interference or any other act or condition beyond the reasonable control of TVTN (“Force Majeure Event”). TVTN shall be not liable for any delay or loss or adverse effect caused to a attendee(s) in the Event as a result of a Force Majeure Event.
2. The attendee(s) acknowledges that his/her right to attend in the Event shall constitute good and valid consideration, binding him/her by the terms of these Terms & Conditions.
3. By participating in the Event, each attendee(s) agrees to be bound by any decisions made by TVTN in its sole discretion, including any interpretations of the Terms & Conditions. No correspondence in this regard shall be entertained and TVTN’s decision shall be final, binding and non-contestable. Attendee(s) acknowledge that the interests of the Event shall override those of any attendee(s).
4. If due to any reason the Event cannot be held as planned, including without limitation any infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Event, or for any other reason whatsoever, TVTN reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Event.
5. You acknowledge and agree that TVTN, in its sole discretion, reserves the right to change any and all aspects of the Event, including but not limited to, the Event name, themes, content, program, speakers, performers, hosts, moderators, venue and time.
6. In the event of any conflict between the Terms & Conditions herein, and any other information displayed on the Website (i.e. terms of use of Website and the privacy policy, including the FAQs (If any), in relation to this Event, the Terms & Conditions herein shall prevail.
7. The Event and Terms & Conditions shall be governed by and construed in accordance with the applicable laws of India. Failure by TVTN to enforce any of these Terms & Conditions in any instance shall not be deemed to be a waiver of the Terms & Conditions and shall not give rise to any claim by any person.
8. These Terms & Conditions are subject to Indian laws and the Courts at New Delhi shall have the exclusive jurisdiction in respect of any disputes or any matter arising here from.
